Welcome to Sleep Return™. These Terms and Conditions (“Terms”) govern your access to and use of the Sleep Return™ website, digital course content, and services (collectively, the “Services”) provided by SleepReturn B.V. (“we,” “us,” “our,” or “Sleep Return™”).
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to all of these Terms, please do not use our Services.
1. ACCEPTANCE OF TERMS
1.1 Binding Agreement. These Terms constitute a legally binding agreement between you and Sleep Return B.V. (John M. Keynesplein 31, 1066 EP, Amsterdam, Netherlands).
1.2 Eligibility. You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.
1.3 Modifications to Terms. We reserve the right to modify these Terms at any time. We will post notice of significant changes on our website. Your continued use of our Services after any changes to these Terms constitutes your acceptance of such changes. It is your responsibility to review these Terms periodically.
2. MEDICAL DISCLAIMER
2.1 Not Medical Advice. The information presented on the Sleep Return™ website and in our program is for informational and educational purposes only. It is not intended as medical advice or as a substitute for medical treatment.
2.2 Consult Healthcare Providers. Always seek the advice of your physician or other qualified healthcare provider regarding any questions about your sleep, health conditions, or well-being before beginning any program, including Sleep Return™.
2.3 Not a Treatment for Medical Conditions. Sleep Return™ is not intended to diagnose, treat, cure, or prevent any sleep disorder, disease, or medical condition. The program is not suitable for individuals with severe psychiatric disorders, active trauma/PTSD symptoms not being managed in clinical care, untreated sleep apnea, narcolepsy, or other diagnosable medical sleep disorders.
2.4 Not for Crisis Support. Sleep Return™ is not appropriate for anyone in crisis, experiencing suicidal ideation, or needing emergency psychological support.
3. SERVICES
3.1 Digital Course. Sleep Return™ primarily offers a 6-step digital course for sleep recovery, with lifetime access granted upon purchase.
3.2 Support Tools. Our Services may include additional features such as the Sleep Assistant support tool, which provides general guidance and is not a substitute for professional advice.
3.3 Service Limitations. We do not offer physical products or in-person consultations. Our Services are educational in nature and not personalized to individual sleep conditions.
3.4 No Guaranteed Results. While we strive to provide high-quality educational content, we cannot and do not guarantee any specific sleep improvements or outcomes. Results vary based on individual factors, commitment, and consistency.
4. USER ACCOUNTS
4.1 Account Creation. To access our Services, you must create an account by providing certain information (such as name, email address, and password).
4.2 Account Security. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.
4.3 Accurate Information. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
4.4 One User Per Account. Each account is for a single user only. You may not share your account credentials with others or allow multiple users to access your account.
5. PAYMENT TERMS
5.1 Pricing. The prices for our Services are displayed on our website and may be subject to change.
5.2 Payment Methods. We accept payment through Stripe, PayPal, and major credit/debit cards. By providing payment information, you represent and warrant that you have the legal right to use the payment method provided.
5.3 Processing. All payment processing is handled by third-party payment processors. Your use of these services is subject to their terms and conditions.
5.4 Taxes. Prices displayed may not include applicable taxes. You are responsible for any taxes that may apply to your purchase.
6. REFUND POLICY
6.1 Satisfaction Guarantee. Our 60-day refund policy is designed to give you complete peace of mind — but also to ensure the program is used as intended.
6.2 Refund Eligibility. To qualify for a refund:
- Your request must be made within 60 days of purchase.
- You must not have completed more than 30% of the program (based on progress data from your account dashboard).
6.3 Refund Process. To request a refund, contact us at [email protected] within the 60-day period. Please include your name and order information.
6.4 Refund Limitations. This policy helps us keep our program protected from abuse, while giving you a generous window to explore the content and decide if it’s a fit for you. Refunds may be denied if there is evidence of fraud, abuse of the refund policy, or excessive refund requests from the same customer.
7. INTELLECTUAL PROPERTY RIGHTS
7.1 Our Intellectual Property. All content, materials, and information on the Sleep Return™ website and in our Services, including but not limited to text, graphics, logos, images, audio clips, digital downloads, video content, and software, are owned by or licensed to Sleep Return B.V. and are protected by copyright, trademark, and other intellectual property laws.
7.2 Limited License. Upon purchase, we grant you a personal, non-transferable, non-exclusive, revocable license to access and use our Services for your personal, non-commercial use only. This license does not include the right to:
- Copy, reproduce, distribute, publicly display, or publicly perform our content
- Modify, adapt, or create derivative works from our content
- Remove any proprietary notices or labels on our content
- Use our content for commercial purposes
- Share access to the program with others
- Transfer your license rights to any third party
7.3 Trademarks. “Sleep Return™” and any related logos, product and service names, designs, and slogans are trademarks of Sleep Return B.V. or its affiliates. You may not use such marks without our prior written permission.
8. USER CONDUCT
8.1 Prohibited Activities. You agree not to:
- Use our Services for any illegal or unauthorized purpose
- Violate any applicable laws or regulations
- Share your account credentials with others
- Copy, distribute, or disclose any part of the Services in any medium
- Attempt to reverse engineer any portion of the Services
- Interfere with or disrupt the integrity or performance of the Services
- Harass, abuse, or harm another person through the Services
- Submit false or misleading information
- Use our Services for commercial purposes without our consent
- Scrape, data mine, or otherwise extract data from our Services through automated means
8.2 Content Submission. If you submit content to us (such as reviews or testimonials), you:
- Represent that you own or have the necessary rights to such content
- Grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, display, and distribute your content for promotional and marketing purposes
- Understand that we may remove your content at our discretion
9. THIRD-PARTY LINKS AND SERVICES
9.1 Third-Party Links. Our Services may contain links to third-party websites or services that are not owned or controlled by Sleep Return B.V.
9.2 No Endorsement. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We do not endorse the offerings of any of these entities/individuals or their websites.
9.3 Use at Your Own Risk. You acknowledge and agree that Sleep Return B.V. shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such third-party websites or services.
10. PRIVACY
10.1 Privacy Policy. Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.
10.2 Communications. By providing your email address, you consent to receive communications from us related to your account and our Services. You may opt out of receiving marketing communications by following the unsubscribe link in our emails.
11. DISCLAIMER OF WARRANTIES
11.1 “As Is” Basis. THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
11.2 No Warranties. TO THE FULLEST EXTENT PERMITTED BY LAW, SLEEP RETURN B.V. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.
11.3 Service Reliability. SLEEP RETURN B.V. DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
11.4 Health Outcomes. SLEEP RETURN B.V. DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE SERVICES IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, EFFECTIVENESS, OR OTHERWISE, INCLUDING ANY HEALTH OR SLEEP OUTCOMES.
12. LIMITATION OF LIABILITY
12.1 No Liability for Damages. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SLEEP RETURN B.V., ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of or inability to access or use the Services
- Any conduct or content of any third party on the Services
- Any content obtained from the Services
- Unauthorized access, use, or alteration of your transmissions or content
12.2 Maximum Liability. IN NO EVENT SHALL SLEEP RETURN B.V.’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE AMOUNT PAID BY YOU TO SLEEP RETURN B.V. FOR THE SERVICES GIVING RISE TO THE CLAIM.
12.3 Exclusions. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain types of damages. Accordingly, some of the above limitations may not apply to you.
13. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Sleep Return B.V., its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that arise from or relate to:
- Your use of the Services
- Your violation of these Terms
- Your violation of any rights of another
- Your content or submissions
14. TERMINATION
14.1 Termination by You. You may terminate your account at any time by contacting us at [email protected].
14.2 Termination by Us. We may suspend or terminate your access to the Services, at our sole discretion, at any time and without notice or liability, for any reason, including but not limited to:
- Violation of these Terms
- Engaging in fraudulent activity
- Initiating chargebacks or payment disputes without contacting us first
- Upon request by law enforcement or other government agencies
14.3 Effect of Termination. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
14.4 Data Retention. We may retain your data for up to 2 years after account termination, unless legally required to retain it longer. You may request earlier deletion of your data in accordance with applicable data protection laws.
15. EXPORT CONTROL
You agree to comply with all applicable export control laws and regulations when using our Services.
16. FORCE MAJEURE
Sleep Return B.V. shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to, acts of God, natural disasters, pandemic, epidemic, war, terrorism, riots, civil unrest, government actions, labor disputes, internet service provider failures or delays, or unavailability of or interruptions in third-party services.
17. GOVERNING LAW AND DISPUTE RESOLUTION
17.1 Governing Law. These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
17.2 Arbitration. Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration in accordance with the rules of the Netherlands Arbitration Institute (NAI). The arbitration shall be conducted in Amsterdam, Netherlands, in the English language.
17.3 Class Action Waiver. YOU AND SLEEP RETURN B.V. AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
17.4 Exceptions. Nothing in this section shall prevent either party from seeking injunctive or other equitable relief from the courts for matters related to data security, intellectual property, or unauthorized access to the Services.
18. SEVERABILITY
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
19. ASSIGNMENT
Sleep Return B.V. may assign or transfer these Terms, in whole or in part, without restriction or notification, including in the event of a merger, acquisition, or sale of assets. You may not assign or transfer your rights under these Terms without our prior written consent.
20. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy and any other legal notices or additional terms and conditions published by Sleep Return B.V. on the Services, shall constitute the entire agreement between you and Sleep Return B.V. concerning the Services.
21. WAIVER
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
